The Criminal Court number 11 of Malaga has convicted the owner of a podenco who died after being locked in his van for several consecutive days in Casabermeja. In the sentence it is considered proven that the man, hunter and rehalero (this is a man who hires out dogs for hunting), was aware that the animal had been diagnosed with leishmania and that it needed urgent treatment to stay alive. The judge imposes a sentence of twelve months in prison and a ban on working in any trade that is related to the treatment of animals. In addition, the magistrate requires him to pay 600 euros to the animal protection association Ladram, whose owners denounced the facts and welcomed the dog, in order to support it.

According to the magistrate in the judgment, to which that diary has had access, ‘in the act of trial it has been established that the accused unjustifiably mistreated a pet’. From the statement of the veterinarian who attended to the dog, the judge considers that »it is clear that the accused did not give him the necessary care required by the animal«. It is also considered proven that at first he did administer the medication, but then began not to do so, to take the animal with him and leave it locked in the van for hours, against the recommendations of the doctor. In addition, veterinary consultations documented a significant state of malnutrition, a liver condition, and flea and tick infections that aggravated their condition.

The judge adds that “instead of isolating him, he should have taken him to the vet and given him the necessary treatment for the cure of the diseases he was suffering from, taking into account how a quick diagnosis and rapid treatment could have saved the animal.” In addition, he says in the ruling that he refused to do more tests and buy the treatment recommended by the professional who took over the case.
The agent who removed the dog from the vehicle one of the days it was abandoned stated at the trial that “the van was dirty”, full of “excrement, ancient scattered food and the sun of justice”. “The situation of the dog was extremely weak,” he added. Following the discovery they inspected the rest of the animals that were on the property of the now convicted and found certain irregularities and another animal with leishmania.

The judge clearly summarizes that the subsequent death of the dog was by the abandonment of the functions of its owner, for its abandonment and for rejecting veterinary advice, leaving it in an enclosed and unhygienic space. In addition, remember that the owner could have euthanized the dog and thus avoided further suffering.

Since Ladram, in statements to SUR, they claim that the sentence occurs in a context in which the Municipality of Casabermeja is not enforcing the autonomous law of Protection of Animals 11/2003, nor complying with the obligations that it requires. ‘It has given rise to an atmosphere of permissiveness which has the consequence of cases such as that set out in the judgment in question,’ they add. “The short-distance policy in small towns becomes in a context of the protection of animals, where the latter are always the losers in any conflict of interest.

(He should be locked in the prison cell with no food, water or light for the term of his sentence!!)
